1. Introduction and Acceptance of Terms

Welcome to Ersal WhatsApp ("Ersal", "we", "the Service"). By using or accessing the Ersal WhatsApp application, you agree to be bound by these Terms of Service. If you do not agree to any of these terms, please do not use the Service.

2. Service Description

Ersal WhatsApp is an all-in-one communication platform that connects your online store with Meta's official WhatsApp Business API to automatically send professional WhatsApp notifications to your customers. The Service includes:

  • Automatic WhatsApp messages triggered by store events (orders, shipments, abandoned carts, invoices)
  • Professional message templates approved by Meta
  • A dashboard to manage templates, settings, and message logs
  • Automatic integration with e-commerce platforms

The Service is fully powered by Meta's official WhatsApp Business API and operates in accordance with Meta's business policies.

3. Registration and Eligibility

To use the Service, you must:

  • Be the owner or an authorized administrator of a registered online store
  • Provide accurate and truthful information during registration
  • Maintain the confidentiality of your account credentials and password
  • Be of legal age in the Kingdom of Saudi Arabia

You are responsible for all activities that occur under your account.

4. Subscription and Payment

Ersal offers monthly and annual subscription plans. By subscribing to a plan, you agree to:

  • Pay the subscription fees as specified on the pricing page according to your chosen billing cycle
  • Automatic renewal at the end of each billing cycle unless cancelled before the renewal date
  • Prices are subject to change with at least 30 days' prior notice

5. Additional Meta Charges

Important: In addition to Ersal subscription fees, WhatsApp conversation charges from Meta apply directly. Each plan includes a set number of free conversations. When you exceed this limit or launch marketing campaigns, additional fees are charged according to Meta's official pricing for your region. These charges are paid to Meta and are not part of the Ersal subscription.

6. Acceptable Use

You agree not to use the Service to:

  • Send spam or unsolicited messages
  • Violate WhatsApp's business policies or Meta's policies
  • Send illegal, offensive, or misleading content
  • Attempt unauthorized access to the Service's systems
  • Use the Service in a way that harms other users or the infrastructure

We reserve the right to suspend or terminate your account if these terms are violated.

7. Intellectual Property

All intellectual property rights related to the Service, including software, designs, and trademarks, are owned by Ersal. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms.

8. Service Availability

We strive to provide the Service continuously, but we do not guarantee it will be free from interruptions or errors. We may perform periodic maintenance or updates that may temporarily affect Service availability. We will make reasonable efforts to notify you in advance of any planned maintenance.

9. Limitation of Liability

The Service is provided "as is" and "as available". We are not liable for:

  • Any direct or indirect losses resulting from the use or inability to use the Service
  • Delays or failures in message delivery caused by issues with Meta or WhatsApp services
  • Any changes in Meta's policies or pricing
  • Data loss resulting from circumstances beyond our control

10. Termination

You may cancel your subscription at any time. Upon cancellation:

  • The Service will continue until the end of your current billing period
  • No refunds will be issued for the remaining period
  • Your data will be deleted 30 days after the subscription expires

We reserve the right to immediately terminate or suspend your account in case of violation of these terms.

11. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through an in-app notification at least 30 days before they take effect. Your continued use of the Service after the modification constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia.
